These terms and conditions of use (“Terms of Use”) govern your use of our online interfaces and properties (e.g., websites) owned and controlled by QUIKTOX, including the quiktox.com website (collectively, the “Site”), as well as the services (“Services”) available to users through the Site. QUIKTOX (“QUIKTOX,” “we,” “us,” and “our”) provides administrative support services for licensed medical professionals who provide healthcare services. The professional medical services and the non-clinical Site services are collectively referred to in these Terms of Use as the “Services.” The terms “you” and “your” refer to you, your dependents, and any other person accessing your QUIKTOX Account.
1. Acceptance of Terms
By accessing or using our Site and Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you are not authorized to use the Site or Services and should exit immediately.
2. Privacy Practices
Information provided by you in connection with the Services shall be governed by the QUIKTOX Privacy Policy, which is incorporated into this Agreement.
3. Services Provided
No Medical Advice by QUIKTOX: The Site enables you to request and book certain services to be provided by licensed medical professionals. QUIKTOX DOES NOT PROVIDE MEDICAL SERVICES OR MEDICAL ADVICE. The services and content offered by QUIKTOX are for informational purposes only and do not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind. Always seek the advice of qualified health care professionals with any questions or concerns you may have regarding your individual needs and medical conditions.
4. User IDs
If you register for an account, you must provide your email address and create a password (“User ID”). You are responsible for maintaining the confidentiality of your User ID and are fully responsible for all activities that occur under your User ID. Notify us immediately of any unauthorized use of your User ID.
5. Proprietary Rights
QUIKTOX retains all rights to the Site, Services, and Content. You are granted a limited, non-exclusive, non-transferable license to access and use the Site and Services for personal use only.
6. User Restrictions
You agree not to:

Use the Site in any manner that could damage, disable, overburden, or impair the Site.

7. Payments and Refunds
Payments: Fees for services are charged at the time of service.
Cancellations: Cancellations within 24 hours of the appointment may incur a fee.
Refunds: Charges for services rendered are final and non-refundable.

QUIKTOX, ITS AFFILIATES, AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SITE OR SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SITE BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT QUIKTOX IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
You agree to indemnify, defend, and hold harmless QUIKTOX, its affiliates, and their respective shareholders, directors, officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from (a) your use of the Site or Services, (b) your violation of these Terms of Use, (c) your violation of any rights of any other person or entity, and (d) any information or content you submit, post, or transmit through the Site or Services.
10. Disclaimers
No Warranties: THE SITE, SERVICES, AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE), AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY QUIKTOX ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. QUIKTOX MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE), OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.

QUIKTOX is not responsible for the content, products, or services on or available from those websites or resources, or links displayed on such sites. 11. Governing Law
These Terms of Use and any action related thereto will be governed by the laws of the State of California without regard to its conflict of laws provisions. Any disputes relating to these Terms of Use will be resolved through binding arbitration in the state or federal courts located in California.
12. Changes to Terms
QUIKTOX may modify these Terms of Use at any time. Your continued use of the Site and Services after any such modification constitutes your acceptance of the new Terms of Use. It is your responsibility to review the Terms of Use periodically for changes.
